From animals to killers

You agree to indemnify, defend and hold harmless the Company and its affiliates, officers, directors, employees, agents, licensors and suppliers from all losses, expenses, damages and costs (within reasonable limits), including attorney's fees, arising out of Your breach of this Agreements. The Company reserves the right to exercise the exclusive defense and control of any claim for damages by you.

LITIGATION

This Agreement shall be deemed to have been entered into in the State of New York and shall be governed by the laws of the State of New York (subject to its conflict of laws rules). Each party to this Agreement submits to the exclusive jurisdiction of the state and federal courts sitting in the Manhattan Borough of New York City, New York, and waives any objection to such courts as to their jurisdiction, venue, or inconvenient venue. You and the Company further agree that: (i) any action to enforce this Agreement must be brought within 2 (two) years of the date on which the cause for such action arose; (ii) only operating expenses are reimbursed, excluding the prevailing party's right to reimbursement of legal costs and attorney's fees; (iii) each claim is filed individually and may not be filed as part of a class action or merged claim.

TERMINATION

The Company may terminate or suspend support for any and all Online Services, and may terminate any registered account immediately, without prior notice or liability, for any reason, including your breach of any provision of this Agreement. If you terminate your account, you will immediately lose your right to use the Online Services. If you wish to delete your account, all you need to do is stop using the Online Services. All provisions of this Agreement which, by their nature, should survive termination, including, without limitation, ownership provisions, warranty disclaimers, releases, and limitations of liability, shall survive termination.

DIFFERENT

If any provision of this Agreement is found by a court or other competent authority or jurisdiction to be unenforceable, such provision shall be limited or excluded to the minimum extent possible; all other provisions of this Agreement shall remain in full force and effect. This Agreement, along with the Privacy Policy available at www.rockstargames.com/en/privacy, and the License Agreement constitutes the entire agreement between You and the Company with respect to the subject matter of the Agreement; any written or oral agreements between you and the Company regarding the subject matter of the Agreement shall be declared null and void. The Company may change the terms of this Agreement at any time in its sole discretion by posting the amended Agreement or, in the case of material changes, by posting such changes on a website page under the heading "Legal Notice" or "Legal Notice" (or similar) before the entry into force of such a change.

APPOINTED AGENT UNDER THE COPYRIGHT ACT IN THE DIGITAL MILLENNIUM

The Digital Millennium Copyright Act (DMCA) provides a mechanism for notifying a service provider of illegal use of copyrighted material. Notice under the DMCA must be sent to the service provider's designated agent.
