  • 03.03.2020

Mac, of course, extremely beautiful plant which has already won the hearts of many. At first glance, the question is, can you grow poppies on your garden plot, sounds funny. It would seem that an ordinary flower, what is forbidden here? However, if you decide to grow poppies in your garden, remember that they are used to make drugs. Consequently, certain types of poppy are prohibited from planting.

For the cultivation of this, at first glance, a beautiful and harmless flower, you can get a fine. And no matter how much you will grow, even one bed is already enough. But if its crops reach the size of a plantation, then you can even get a prison sentence of up to eight years. Therefore, with poppies, you should be extremely careful and bypass some varieties.

What varieties should never be planted

Most varieties can be safely used to decorate a garden plot. But there are also those that are not allowed:

  • oriental poppy (alas, the most beautiful representative of poppies, but you can get a term for it);
  • soporific poppy;
  • bristle-bearing.

Dangerous and prohibited varieties are easily identified. If the seed box is large, then immediately destroy the crops of such a plant. Tiny no one cares.

Which poppies are suitable for growing

The number of safe varieties far exceeds those for which they can be held liable. The most beautiful among them will be:

  • samoseyka;
  • poppy modified;
  • peacock;
  • hollow stem.

The first, self-seed poppy, is perhaps the most famous of all those listed in the article. In addition, it is a perennial, and therefore will delight you with its red color year after year.

Less common are the second and third grades. They, alas, are only annuals, but they bloom incredibly beautifully. However, they can be propagated by seeds.

In the garden of a pensioner from Krasnoyarsk, they found 19 poppy bushes. She now faces up to two years in prison.

Criminal case for 19 poppy bushes in the garden. A Krasnoyarsk pensioner faces up to two years in prison. Local police received a report that a 59-year-old woman was growing illegal plants on her property. Upon arrival, the criminal investigation officers found and seized 19 poppy bushes.

The pensioner was detained, a case was initiated under the article "illegal cultivation of plants containing narcotic substances prohibited for cultivation." Doesn't this mean that this can threaten any summer resident who has a poppy on his site? Business FM asked lawyer Suren Avanesyan to clarify the situation:

Advocate “Criminal liability under the article “For the illegal cultivation of plants containing narcotic drugs” occurs regardless of the purpose of growing these plants. The list of plants itself, for the cultivation of which there is criminal liability, is approved by a government decree, including in this case, criminal liability comes for the cultivation of sleeping pills poppy and other types of poppy, of this same genus, containing narcotic drugs. That is, if the cultivated poppy was a representative of this type of poppy, then, regardless of the purpose of cultivation, criminal liability arises. And criminal liability comes from the number of plants more than 10 pieces, that is, in this case, a large size is obtained. Figuratively speaking, if you grow hemp, it doesn’t matter at all for what purpose you grow it - whether you will weave ropes from it, you will sew shirts from it, or you will make drugs from it - criminal liability under Article 231 occurs in any case, because you are cultivating plants prohibited from cultivation by government decree.

What kind of poppy was grown by a resident of the Krasnoyarsk Territory is unknown. However, such cases are not uncommon, says Pavel Stabrov, a journalist from Krasnoyarsk:

Pavel Stabrov journalist “I can’t say that this happens too often, but once or twice a year, events of this kind flicker in the tapes. I think this is due to the fact that most people cannot get along with each other for some reason, even with neighbors. Someone will write something to someone. I think that this case, 19 poppy bushes, my grandmother either planted them for herself, or maybe he got enough sleep by self-sowing, because in Siberian gardens, Siberian gardens the poppy has always grown, no one has ever seen anything terrible in it. I also grew up in the village, as a child, my grandmother always grew poppies in the garden - pink and red flowers. The delicious product that was obtained from them was poppy, they baked buns with it, various bread, rolls, muffins and so on. Now it has crossed some strange boundaries. Dozens of kilograms of heroin are sent by trucks from Central Asia, they brought a truck with onions to beat off the smell, and so on. Against this background, the miserable 19 bushes are about nothing.

According to experts, traces of opium can be found when checking any poppy, even super-cleaned. Thousandths of a gram can be found in dryers, rolls, and other poppy-seed baked goods sold in grocery stores.

A year ago, a big resonance was caused by those who baked poppy seed buns and sold them in a family cafe. As a result, they were found guilty of illegal sale of drugs and sentenced to more than eight years each. The media also recalls another story: three years ago, in Transbaikalia, almost two thousand poppy bushes were found on the site of one of the local deputies.

Now it is rare in any garden to find silk flowers of poppies, which until recently adorned literally every plot. And after ripening, it was possible to collect the boxes, pour out the seeds from them and ... send them to your mouth. Well, they are just very tasty ... They were.

Now people are afraid to grow poppies on their plots. Yes, and it is impossible - a ban has been imposed on the cultivation of poppies in Russia.

So what is the fault of this delicate flower? Let's figure it out.

The poppy family is huge: there are both annuals and perennials. There are varieties with simple flowers, and there are - with terry, more like peonies. But... Any poppy contains narcotic substances. Therefore, according to the law, there should not be any poppy in the country. It should not be grown for any good purpose: neither for culinary use nor for cosmetic purposes.

Gardeners are often misled by horticultural firms selling poppy seeds. Usually under the guise of decorative. Often poppy seeds are found in a mixture of flowers (for example, in a mixture of Moorish lawn). So the illusion arises - since the seeds are sold, it means that you can plant them. In the end - for beauty we plant. This is not so, if a gardener planted a poppy containing narcotic substances on his plot, then he violates the law, and according to the law he is threatened with punishment.

So what kind of poppy can not be grown?

Now gardeners are not allowed to grow the following types of poppy: hypnotic, bristle-bearing, bracts. But that's not all. It is forbidden to grow varieties of poppies, the diameter of which is from 2-5 cm or more. Usually these are all annual poppies and some varieties of perennials. This is especially true for the oriental poppy, which gardeners are very fond of planting.

What threatens for a flower garden with poppies?

Of course, the real term is unlikely to be awarded to a simple florist. To begin with, they will warn and ask all poppy flowers to be pulled out and disposed of. If you do not obey or zealously stand up for the protection of flowers, driving the police officers away from the flower garden with pitchforks or rakes, you will receive a fine. Well, those who grow poppy products on a large and especially large scale (this does not apply to flower growers) face a serious deadline.

In addition to police officers, poppy flowers can attract people to your site who are strongly addicted to poppy dope. Therefore, before planting poppies, weigh the pros and cons. Moreover, buns with poppy seeds can be bought at any store.

How a grandfather hit a young neighbor

Home • Law • We grow poppies in the garden, legal advice

Klavdiya Skorikova, Moscow: "Knowing that I love poppy, my friend gave me a lot of different seeds - oriental, peony, and self-seed.

But various young people often roam our SNT and beg for these flowers. They are polite, but unpleasantly intrusive, I am always afraid of them. Now at least throw away the gift seeds! Is poppy begging legal? How to threaten lovers of ephemera? How to be safe?"

To begin with, you must know that the current legislation prohibits the cultivation of certain types of poppy in large quantities even in a garden plot (Decree of the Government of the Russian Federation of November 27, 2010 No. 934 "On approval of the list of plants containing narcotic drugs or psychotropic substances or their precursors"). The last word means everything that is involved in the production of drugs.

So the cultivation of such plants in the country is subject to strict control.

Alas, today young people often go to summer cottages. If the faces of beggars are familiar to you, you need to warn the district police officer. But, as a rule, these people are hardly seen before.

Therefore, try to "hide" a flower bed with your favorite flowers away from prying eyes. My parents simply stopped growing all kinds of poppies and mercilessly weeded out the "self-sowing" shoots.

In spring and summer law enforcement conduct special Mac programs, and they are very effective. Thousands of facts of illegal crops are revealed, tons of drug-containing plants are confiscated and destroyed.

You risk nothing if you have less than 10 poppy plants on your site. But by no means more!

Confectionery poppy, responsible for marketing or manufacturing

Confectionery poppy has been outlawed since 1986 to this day. For its cultivation, they can be prosecuted if it is established that the purpose of lovers of these flowers is the sale or manufacture of a drug. Art. 231 part 1 of the Criminal Code of the Russian Federation "Illegal cultivation of plants containing narcotic substances prohibited for cultivation" provides for imprisonment for up to 2 years. Evidence can be a large number of these plants.
